These Terms of Use apply to the translation service offered on english-to-spanish.com ("the Website"), operated by Christoph Kaesler, Ernst-Rieck-Straße 4, 18225 Kühlungsborn, Germany. By using the service, you agree to these Terms.

2. Description of Service

The Website provides AI-powered English-to-Spanish translation services and related language-learning features. Translation results are generated using artificial intelligence and are intended for informational and educational purposes only.

3. Free Use

The translation service is free to use via the web interface for both personal and commercial purposes. No registration is required.

4. AI Translations — No Warranty

Translations are generated by an AI model (Large Language Model). There is no guarantee of accuracy, completeness, or timeliness. For medical, legal, technical, or safety-critical texts, review by qualified professionals is mandatory. This service is not a substitute for professional or certified translation.

Input text is transmitted to the AI service Mistral AI (Paris, France, EU) for processing and is not permanently stored. We have deactivated the training of our API inputs on AI models in the Mistral Admin settings.

5. Prohibited Use

The following is not permitted:

• Automated querying or scraping of the API or website (e.g., via bots, crawlers, or scripts)
• Circumventing or disabling technical safeguards, particularly rate limiting
• Using the service to translate confidential, sensitive, or personally identifying information (medical records, financial data, legal documents containing personal information)
• Submitting unlawful, offensive, harassing, defamatory, or harmful content
• Reselling or commercially integrating the service into your own products without explicit written consent

6. Rate Limiting and Abuse Protection

To prevent abuse and ensure service stability, we employ rate limiting. In cases of excessive or abusive use, we reserve the right to temporarily or permanently restrict access.

7. Intellectual Property

All content of the Website, including text, graphics, logos, and design, is protected by copyright. AI-generated translations may be used for personal purposes but may not be commercially exploited without express written permission.

8. Disclaimer of Liability

The Website and its translation services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant the accuracy, completeness, or timeliness of AI-generated translations.

To the maximum extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website
• We are not liable for damages caused by errors or inaccuracies in AI-generated translations, including but not limited to misunderstandings, missed business opportunities, or other losses
• Our total liability for any claims arising from the use of this Website is limited to the amount paid by you for the service (which is zero, as the service is free)

This limitation does not apply to damages caused by intentional misconduct or gross negligence, nor to mandatory consumer protection rights under applicable law.

9. Availability

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

For disputes arising from these Terms, the courts of Rostock, Germany, shall have exclusive jurisdiction, subject to mandatory consumer protection laws of the user's country of residence. Consumers retain the right to bring proceedings before the courts of their habitual residence where mandatory law so provides.

12. Final Provisions

Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.
